The National Greenhouse and Energy Reporting Act 2007 (NGER Act) affects all organisations that produce or emit greenhouse gases at or above thresholds outlined by the legislation.

In Australia, corporations must apply for registration if their corporate group emits greenhouse gases and or produces or consumes energy at or above the specified thresholds for the NGER environmental reporting year.  Registration must be completed by 31 August of the specified reporting period, with NGER’s reports due to be submitted by 31 October of the specified environmental year.

Important Annual Dates

1st July

Start of the reporting year. 

National facility nominations for transport facilities are due under the safeguard mechanism.

30th June

End of the reporting year. Section 22X agreements due.

31st July

Applications for calculated baselines are due, if production levels are expected to peak in the current financial year, rather than in future years.

Requests for ‘opt-in’ reported baselines are due.

31st August

NGER registration applications (corporations only need to register once, for the first year they trigger a threshold) and nominations of operational control are due.

31st October

NGER reports are due.

28th February

Extract of the National Greenhouse and Energy Register and data for the previous (financial year) reporting period is published.

Publication of aggregated scope 1 emissions from electricity generators that will be covered by the sectoral baseline.

Reporting Thresholds

Facility level

  • 25 kt or more of greenhouse gases (CO2-e) (scope 1 and 2)
  • production of 100 TJ or more of energy, or
  • consumption of 100 TJ or more of energy.

Corporate group level

  • 50 kt or more of greenhouse gases (CO2-e) (scope 1 and 2)
  • production of 200 TJ or more of energy, or
  • consumption of 200 TJ or more of energy.
